Our Terms of Service policy is actively and strictly enforced. Offending content or users will be suspended or deleted, usually as soon as they are discovered. Common sense is your best guide as to what is considered acceptable use, however the following are unacceptable uses. Users agree that they, themselves are responsible for their own actions and Kreative Hosting Solutions will not be held liable for their content and/or actions.

Illegal Use
Kreative Hosting Solutions may not be used for illegal purposes, or in support of illegal activities. This includes, but not limited to, unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or obscene material.

Undesirable Content
Certain types of content are not permitted on Kreative Hosting Solutions' servers. We will not host illegal adult content. If you wish to host an adult web site here, you agree that you will be held solely responsible if any legal action is taken by any person. Kreative Hosting Solutions may request proof of age at any time for those who are hosting adult websites.

Content relating to hacking, cracking, warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software (including free software) is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work. Lastly, the use of "Spam Karma" for WordPress blogs is forbidden, this plugin requires resources from our mail server and may delay the delivery of e-mails to our customers. For handling spam on your blog, we suggest using Akismet.

Spam
You may not use Kreative Hosting Solutions to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on Kreative Hosting Solutions is strictly forbidden.

Billing
Kreative Hosting Solutions will bill clients once a month without refund regardless of use. If during this period a customer cancels their account they will not receive any refund. Customers cannot put their accounts on hold or delay. Customers strictly prepay for the time they use.

If a payment is not received, we reserve the right to suspend your account and may delete all remaining data after 3 days unless otherwise noted by our billing department. If an account is removed due to a violation of this Terms of Service we reserve the right not to refund payments. Accounts that are 3 days over-due on payment are subject to late fees and/or reinstatement fees should your account be terminated and/or suspended. If you send a request to Kreative Hosting Solutions, we will terminate your hosting account immediately regardless of when your next payment is due, no refunds will be issued. PayPal Subscriptions
A PayPal subscription is created when you begin a hosting account with Kreative Hosting Solutions. This means you will automatically be billed via PayPal once every month for your hosting account (including reseller hosting accounts). It is the responsibility of you, our customer, to terminate the hosting subscription in your PayPal account should you wish to no longer host with Kreative Hosting Solutions. We will not terminate a subscription for you nor will a refund be issued if you fail to terminate your hosting subscription when you terminate your hosting account.

Misuse Of Resources
Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP message forum. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.

Abuse
Any attempts to undermine or cause harm to Kreative Hosting Solutions, its servers, or its customers is strictly forbidden. Abuse in any shape or form towards Kreative Hosting Solutions, its customers or staff is strictly forbidden and legal action may be taken depending on how serious the issue is. To report abuse or SPAM abuse, please forward all messages, including headers to Support @ kreativehostingsolutions.com.

Data Storage
It is the responsibility of the customers of Kreative Hosting Solutions to ensure that their website has a constant backup stored off of our servers. While we do maintain regular back-ups, this cannot be relied upon in the event of a problem with your hosting account. Please, maintain a current copy of your sites' content and databases at all time.

Resellers
Kreative Hosting Solutions only provides technical support to our reseller. We do not support our reseller's customers. Additionally, our unlimited reseller accounts really are unlimited. However, all data contained on all hosting accounts MUST be specific to the website that is storing the data. Our servers are not to be used as data storage.

Modification
Kreative Hosting Solutions reserves the right to add, delete, or amend these Terms of Service at any time without notice.
